Preliminary clearance vs a full licence

Preliminary clearance, sometimes described as a no-objection step, means the regulator has allowed a firm to move forward in the licensing process. It is not the same as a full licence to operate. Under the Act, running an unlicensed virtual asset business can lead to heavy fines and prison terms, so the difference matters most for the companies themselves. For users, it means the rules around consumer protection, complaints and bank access are still being put in place.

What this means if you use an exchange

  • Check PVARA's website for the current list of licensed or cleared firms before depositing money.
  • Keep records of your deposits, trades and withdrawals in rupees.
  • Expect rules on KYC, bank transfers and tax to tighten as licensing is completed.
  • Be careful with any "Binance agent" or local middleman who asks you to send money outside the platform.
